Agenta ("we", "us", or "our") is committed to protecting your privacy. This Privacy Policy describes how we collect, use, and protect information you provide when using our Service at getagenta.com.

2. Information We Collect

We collect the following types of information:

  • Account information: name, email address, and profile data provided during registration via Clerk.
  • Business profile data: business name, industry, target audience, revenue goals, and other information you provide to personalize AI outputs.
  • Usage data: content generated, tools used, session metadata, and feature interactions.
  • Billing data: payment method details processed and stored securely by Stripe. We do not store full card numbers.
  • Ad performance data: spend, clicks, and conversion metrics you log for your saved ads.

3. How We Use Your Information

We use collected information to:

  • Provide and personalize AI-generated content and strategy outputs
  • Process payments and manage subscriptions
  • Improve the Service and develop new features
  • Communicate with you about your account or updates
  • Comply with legal obligations

4. Data Sharing

We do not sell your personal data. We share data only with the following third-party processors, each of which has its own privacy policy governing how they handle data:

  • Stripe: payment processing and subscription billing.
  • Clerk: authentication and user identity.
  • Supabase: primary database and file storage.
  • Vercel: hosting and infrastructure.
  • Anthropic: AI queries (text generation, coaching, content) are sent to Anthropic's Claude API to generate outputs.
  • OpenAI: image generation requests are sent to OpenAI's DALL-E API.
  • ElevenLabs: text-to-speech generation requests are sent to ElevenLabs' API.
  • Resend: transactional and onboarding emails are sent via Resend.
  • PostHog: product analytics, pageviews, feature interactions, error events, and anonymized session data, to help us understand how the Service is used and improve it. PostHog stores data on its own servers under its own privacy policy.

We may disclose data if required by law or to protect the rights and safety of our users.

When you use Agenta's AI features, including the AI Coach, Content Studio, Offer Builder, and Strategy tools, the business information you provide, including your offer details, ideal client description, revenue information, business goals, and brand voice, is sent to Anthropic's API to generate personalized responses. This data is used solely to personalize your Agenta experience and is not used to train AI models. We do not sell your business data to third parties. You can request deletion of your business profile data at any time by contacting hello@getagenta.com.

5. Data Retention

We retain your data for as long as your account is active or as needed to provide the Service. You may request deletion of your account and associated data by contacting us at hello@getagenta.com. Some data may be retained for legal or billing compliance purposes.

6. Security

We implement industry-standard security measures to protect your data, including encrypted connections (HTTPS), secure database access controls, and authentication via Clerk. No system is 100% secure, and we cannot guarantee absolute security.

7. Cookies and Analytics

We use the following cookies and tracking technologies:

  • Authentication cookies: set by Clerk to keep you signed in. These are essential and cannot be opted out of without signing out.
  • Preference cookies: small browser-storage entries we use to remember your theme choice (light/dark) and similar UI preferences.
  • Analytics (PostHog): used to capture pageviews, feature interactions, and error events to help us improve the product. You can decline analytics tracking via the consent banner shown on your first visit, or by emailing hello@getagenta.com to be opted out at any time.

We do not use advertising cookies or sell tracking data to third parties.

8. Your Rights

Depending on your jurisdiction, you may have the right to access, correct, or delete your personal data. To exercise these rights, contact us at hello@getagenta.com. We will respond within 30 days.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by updating the date above. Continued use of the Service constitutes acceptance of the updated policy.
